If the water mains were town owned, whichever dept. in the town hired them might want to review companies’ OSHA history before letting them bid/hiring them. Or have a rule/bylaw that forbids companies on OSHA’s “severe violations list” from bidding, or supervise them? If there had been an accident or death, would the town have been potentially co-liable?
